Information on the NPDES Construction General Permit Available
On July 28, 2008, the DOE Office of Environmental Policy and Assistance (HS-22) issued an Information Notice, "National Pollutant Discharge Elimination System [NPDES] General Permit for Stormwater Discharges from Construction Activities" that discusses the General Construction Permit (GCP) that authorizes the discharge of sediment-laden stormwater associated with construction activities. Under Section 402(a)(1) of the Clean Water Act, DOE operations are required to obtain a NPDES permit for stormwater discharges from construction sites. Operators of construction sites located in states without an authorized NPDES stormwater program are subject to the provisions of the CGP. FAQ on DOE Order 450.1A Available
On July 28, 2008, the DOE Office of Environmental Policy and Assistance (HS-22) issued an Information Brief, DOE Order 450.1A Frequently Asked Questions (HS-20-IB-2008-11, July 28, 2008), to address questions brought about by revisions to the previous DOE O 450.1 (issued in January 2003). DOE Order 450.1A incorporates new requirements of Executive Order (EO) 13423, Strengthening Federal Environmental, Energy, and Transportation Management (issued in January 2007), and "Instructions for Implementing EO 13423" (issued by the Council on Environmental Quality in March 2007). Presentation on Implementing DOE Orders 450,1A and 430.2 Available
On July 24, 2008, staff from the DOE Office of Environmental Policy and Assistance (HS-22) presented a slideshow, "Implementing DOE Orders 450,1A and 430.2B", at the "Earth, Wind, and Sun" EMS Conference held at Sandia National Laboratory, New Mexico. The new DOE O 450.1A establishes Environmental Management Systems (EMS) requirements and goals for specific sustainable environmental practices. The new DOE O 430.2B addresses conservation and efficiency goals. The HS-22 presentation provides an overview of these two orders' requirements and goals and how they can be integrated into DOE's Environmental Management and Integrated Saftey Management (ISM) systems with the goal of a more "sustainable" and "greener" DOE. Information on Amendments to the NESHAP for Hazardous Waste Combustors Available
On June 18, 2008, the DOE Office of Environmental Policy and Assistance (HS-22) issued an Environmental Information Notice entitled, Environmental Protection Agency Final Clean Air Act Rule: Amendments to the NESHAP for Hazardous Waste Combustors, which summarizes an April 8, 2008, EPA final rule (73 FR 18970) that amends the National Emission Standards for Hazardous Air Pollutants (NESHAP) for hazardous waste combustors at 40 CFR 63, Subpart EEE. The amendments clarify several compliance and monitoring provisions in Subpart EEE and also correct several omissions and typographical errors in the October 12, 2005, final rule. The final rule does not change the October 14, 2008, compliance date established by the October 12, 2005, final rule. What’s New in DOE Order 450.1A?
On June 4, 2008, the Deputy Secretary approved DOE Order 450.1A, Environmental Protection Program. This Order revises the previous DOE O 450.1 (issued in January 2003) to incorporate the new requirements of Executive Order 13423, Strengthening Federal Environmental, Energy, and Transportation Management (issued in January 2007), and Instructions for Implementing E.O. 13423 (issued by the Council on Environmental Quality in March 2007). DOE O 450.1A contains requirements to:
- implement sustainable practices (addressed in DOE O 450.1A and DOE O 430.2B, Departmental Energy, Renewable Energy and Transportation);
- have EMSs that "reflect the EMS elements and framework found in ISO 14001:2004";
- include in EMSs specified compliance management elements such as an environmental compliance audit program;
- conduct a "formal audit by a qualified party outside the control or scope of the EMS" before declaration of initial implementation and every three years thereafter; and
- have DOE managers declare DOE EMSs in conformance with new requirements by June 30, 2009.
